Justifica-se pela relevância da incorporação de contribuições interdisciplinares a partir de marcos epistemológicos bem delimitados em vista da polissemia e idiossincrasia dos termo “análise” e “domínio. A busca recuperou 80 artigos, dos quais 50 demonstraram aderência ao estudo. Concluiu-se que embora a análise do domínio seja uma proposta (...) característica do paradigma social da Ciência da Informação, sua aplicação preserva perfis mais tradicionais. (shrink)

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

O presente artigo analisa o crescimento das instituições escolares salesianas no Antigo Sul de Mato Grosso no final do século XIX e início do XX e o ideal de um processo civilizador educacional, empreendido pela Igreja Católica, protagonizado pela congregação salesiana a qual atuou para assegurar prerrogativa educacionais ao passo que o Estado brasileiro laicizava-se. Essa análise terá como suporte bibliográfico a obra de Riolando Azzi (1982) que em sua obra Os salesianos no Brasil à luz da História, destaca o (...) papel exercido pelo Manual Civilizador dos salesianos. This paper presents Integrated Information Theory (IIT) 4.0. IIT aims to account for the properties of experience in physical (operational) terms. It identifies the essential properties of experience (axioms), infers the necessary and sufficient properties that its substrate must satisfy (postulates), and expresses them in mathematical terms. In principle, the postulates can be applied to any system of units in a state to determine whether it is conscious, to what degree, and in what way. IIT offers a parsimonious explanation of (...) empirical evidence, makes testable predictions, and permits inferences and extrapolations. IIT 4.0 incorporates several developments of the past ten years, including a more accurate translation of axioms into postulates and mathematical expressions, the introduction of a unique measure of intrinsic information that is consistent with the postulates, and an explicit assessment of causal relations. By fully unfolding a system's irreducible cause-effect power, the distinctions and relations specified by a substrate can account for the quality of experience. (shrink)

RESUMEN Partiendo de la discusión del concepto de carne, en este trabajo analizo la común estructura ontológica/biopolítica que comparten los animales humanos y no humanos. Para ello me sirvo de los feminismos materiales y utilizo los hallazgos teóricos del feminismo animalista. También examino la noción de "encierro" en tanto concepto biopolítico que produce un nuevo tipo de ser vivo. Todo ello para, en último lugar, articular un sentido positivo del concepto de encarnación que permita construir comunidad animal. ABSTRACT In this (...) article, I analyze the common ontological/biopolitical structure shared by human and non-human animals, starting out from the discussion of the concept of flesh. To that effect, I resort to material feminisms and to the theoretical findings of animal rights feminism. I also examine the notion of "enclosure" as a biopolitical concept that produces a new kind of living being. As cada vez mais freqüentes referências ao pensamento de Peirce feitas pela contemporânea filosofia da ciência não têm sido capazes de esconder a dificuldade encontrada de assumi-lo em sua integridade. A maior parte das citações é parcial e contradiz o conjunto da doutrina. Parece ser mais fácil chamar para conversação William James e John Dewey do que chamar seu inspirador comum. A razão última deste desafio parece se encontrar na radicalidade do realismo falibilista, dificilmente aceitável pela maioria das filosofias (...) atuais. The increasingly frequent references to Peirce's thought made by the contemporary Philosophy of Science are not able to conceal the difficulty found in assuming that thought in its entireness. The most part of the quotations made are partial and contradict the whole of the doctrine. It seems easier to call James and Dewey to conversation than to call their common inspirer. The ultimate reason for this challenge seems to lie in the radicality of the fallibilist realism, hardly acceptable by almost all the present philosophical currents. (shrink)

Scientific models may be more useful for false assumptions they make than true ones when one is interested not in the fit of the model, but in the form of the residuals. Modeling Darwin’s “blending” theory of inheritance shows how it illuminates features of Mendelian theory. Insufficient understanding of it leads to incorrect moves in modeling population structure. But it may prove even more useful for organizing a theory of cultural evolution. This paper argues that we ought to conceive of the Dark Energy problem—the question of how to account for observational data, naturally interpreted as accelerated expansion of the universe—as a crisis of underdetermined pursuit-worthiness. Not only are the various approaches to the Dark Energy problem evidentially underdetermined; at present, no compelling reasons single out any of them as more likely to be true than the other. More vexingly for working scientists, none of the approaches stands out as uncontroversially preferable over (...) its rivals in terms of its rationally warranted promise, i.e. the reasons to further work on, explore, and develop it. We demonstrate this claim by applying a Peircean economic model of pursuit-worthiness in terms of a cognitive cost/benefit estimate—with the instantiation of theory virtues as key indicators of cognitive gains—to the four main Dark Energy proposals (the cosmological constant approach, modified gravity, quintessence, and inhomogeneous cosmologies). According to our analysis, these approaches do not admit of an unambiguous, or uncontroversial, ranking with respect to which ansatz deserves distinguished attention and research efforts. The overall methodological counsel that our analysis underwrites recommends a pragmatic double research strategy forward: to encourage and foster theory pluralism and the search for tests—with the goal of enhancing the testability of the \(\Lambda \) CDM model and “testing it to destruction". “The Will to Believe” defines the religious question as forced, living and momentous, but even in this article James asserts that more objective factors are involved. The competing religious hypotheses must both be equally coherent and correspond to experimental data to an equal degree. Otherwise the option is not a live one. “If I say to you ‘Be a theosophist or be a Mohammedan’, it is probably a dead option, because for you neither hypothesis is likely to be alive.” James, (...) WB, p. 3. Analogously, in A Pluralistic Universe James is at pains to convince the reader that his own religious hypothesis is just as “objective,” makes just as much sense, etc. as alternative possibilities: the “only thing I emphatically insist upon is that it [pluralistic pantheism] is a fully coordinate hypothesis with monism. This world may, in the last resort, be a block universe; but on the other hand, it may be a universe only strung along, not rounded in and closed. Reality may exist distributively just as it sensibly seems to, after all. On that possibility I do insist.”William James, A Pluralistic Universe (New York: Longmans, Green, and Co., 1909) p. 328.Here, once again, before the will to believe can be employed, the objective factors of competing hypotheses, their equal coherence and correspondence, must be brought out.When reconstructed, James' overall outlook has a “qausi Kuhnian” taint to it- though obvious differences remain. Much of what goes on in evaluating competing scientific hypotheses is either not forced, or not living, or not momentous, but rather “typical,” “dead,” and “avoidable,” in short very “normal.” But there are moments in the history of science where the decision between hypotheses might well be forced, living and momentous, and sometimes James comes close to recognizing this.Analogously, a good deal of what goes on in religion is not forced, not living or not momentous - in short it is all too “normal”. In The Varieties of Religious Experience for example, James proposes to ignore the institutional branch of the religious domain and to concentrate on personal and psychological factors, his reason being that the institutional aspect concentrates on the routine, the normal. “Worship and sacrifice, procedures for working on the dispositions of the deity, theology and ceremony and ecclesiastical organization, are the essentials of religion in the institutional branch. Were we to limit our view to it, we should have to define religion as an external art, the art of winning the favor of the gods.” James, VRE, p. 29. and again “The word ‘religion,’ as ordinarily used, is equivocal. A survey of history shows us that, as a rule, religious geniuses attract disciples, and produce groups of sympathizers. When these groups get strong enough to ‘organize’ themselves, they become ecclesiastical institutions with corporate ambitions of their own. The spirit of politics and the lust of dogmatic rule are then apt to enter and to contaminate the originally innocent thing; so that when we hear the word ‘religion’ nowadays, we think inevitably of some ‘church’ or other.” Clearly here religion has a normal, i.e. trivial side, just as does science. On the other hand, there are revolutionary moments in religion, such as that of choosing between theism and materialism in Pragmatism, or choosing among theism, monistic pantheism and pluralistic pantheism in A Pluralistic Universe. Such moments involve the will to believe and are clearly more personal than their counterparts in the domain of normal institutionalized religion. Going further, there are no doubt differences of degree between the will to believe decisions in science and the will to believe decisions in religion. These have been explicated in more specific terms by Ian Barbour in his article, “Paradigms in Science and Religion.” ...each of the ‘subjective’ features of science... is more evident in the case of religion: (1) the influence of interpretation on data, (2) the resistance of comprehensive theories of falsification, and (3) the absence of rules for choice among paradigms. Each of the corresponding ‘objective’ features of science is less evident in the case of religion: (1) the presence of common data on which disputants can agree, (2) the cumulative effect of evidence for or against a theory, and (3) the existence of criteria which are not paradigm-dependent. It is clear that in all three respects religion is a more ‘subjective’ enterprise than science. But in each case there is a difference of degree - not an absolute contrast between an ‘objective’ science and a ‘subjective’ religion. Barbour correctly notes that the “...choice is not between religion and science, but between theism, pantheism, and naturalism, let us say, as each is expressed in a particular historical tradition. No basic beliefs are capable of demonstrable proof.”Ibid., p. 243. James sometimes comes close to recognizing this but his oscillation on the status of the everyday world of common sense, or the perceptual world, causes him not to see the issue clearly. When the animated world of the perceptual is taken as the all inclusive ‘really real,’ science is viewed as an abstract, second class citizen. But James offers what we would consider a more sophisticated and adequate perspective when he views the world of common sense, having become linguistified, as itself suspicious, and consequently views all three tiers - common sense, scholastic philosophy, and science - as “regional ontologies”, or “language games” in Wittgenstein's terminologySee Ludwig Wittgenstein, Philosophical Investigations, translated by G.E.M. Anscombe (New York: The Macmillan Company, 1953), paragraph 7, paragraph 23. For the notion of “regional ontology” see Edmund Husserl, Ideas, translated by W.R. Boyce Gibson (New York: Collier Books, Macmillan Publishing Company, Inc., 1962) p. 57ff; p. 158ff. - and opposes all three to a more primordial or prereflexive level. When James takes this second approach it is easier to see that the basic distinction he began to make in “The Will to Believe” was between the scientific and religious domain where the will to believe was to be employed, and the domain of “ordinary” religion and science. Finally this position anticipates his ultimate metaphysical outlook, viz. “pure experience” as approachable through language on a series of diverse regional levels, but nonetheless not completely describable within language. It is important to recall that in The Varieties of Religious Experience James distinguishes between the science of religions and what he calls living religion: [T] he science of religions may not be an equivalent for living religion; and if we turn to the inner difficulties of such a science, we see that a point comes when she must drop the purely theoretic attitude, and either let her knots remain uncut, or have them cut by active faith. James, VRE, p. 489. The study of religion, in short is not the activity of religion; the latter is animated, personal, and, we would argue, necessitates a commitment in terms of the will to believe. Once again, however, James hesitates over offering the same two-fold delineation in other areas of science. On the one hand he tells the reader that “science-has ended by utterly repudiating the personal point of view.”Ibid., p. 491. On the other hand, he offers the following comment a few pages later on in a footnote: ...the divorce between scientist facts and religious facts may not necessarily be as eternal as it at first sight seems, nor the personalism and romanticism of the world, as they appeared to primitive thinking, be matters so irrevocably outgrown. The final opinion may, in short, in some manner now impossible to forsee, revert to the more personal style, just as any path of progress may follow a spiral rather than a straight line. If this were so, the rigorously impersonal view of science might one day appear as having been a temporarily useful eccentricity rather than the definitely triumphant position which the sectarian scientist at present so confidently announces it to be.Ibid., p. 501, Footnote. The burden of this paper has been to indicate that when James' two-fold outlook on perception and/or common sense is properly reconstructed, the raproachment between science and religion is not so “impossible to forsee.”. The aim of this paper is to analyze the theoretical commitments and the legal-political problems of Hans Kelsen’s thought from the perspective of Herman Dooyeweerd’s philosophy. It seeks to answer the following question: Why was the relationship between state and law in Kelsen’s thought unable to protect civil society and individuals from the power of the state? The argument, based on Herman Dooyeweerd’s philosophy, is that Kelsen was trapped in an insurmountable theoretical dialectic or tension between nature and freedom. In (...) pursuit of methodological purity, Kelsen reduced the state and law to the logical aspect and morality to the historical aspect. Analyzing Kelsen’s thought from the point of view of Dooyeweerd’s transcendental critique, this paper demonstrates that Kelsen’s commitments with respect to reality led him to a reductionist theory that rendered society defenseless against the power of the state. In this comment I discuss the role of an ethics case consultant in an institutional setting, in contrast to situations when an ethics consultant serves an individual client. In the former situation, I believe the case consultant should articulate ethical issues, options, and arguments, but not recommend a particular course of conduct. In the latter situation, the role of the ethics consultant can be defined and determined in negotiations with the client.

After presenting a brief history of the idea of a human right to an adequate environment as it has evolved in the United Nations documents, I assess this approach to our moral responsibility with regard to the environment. I argue that although this rights approach has some substantial weaknesses, these are outweighed by such clear advantages as its action-guiding nature and its political potency.

The European election which took place on June 17, 1984 must be seen in a more national than European context. Compared with previous general elections, the turn-out was generally lower and individual candidates polled a larger number of votes. Ought the Christian Democrats and Liberals, who make up the ruling coalition, be pleased about their respective results? A careful approach is required to answer that question. For the country as a whole, thefour governing parties lost 2.45 % of their share (...) of the vote in relation to the 1981 general election. This cannot be seen either as a massive repudiation or as a very satisfactory result. After two and a half years in power, this can be regarded as an average performance. However, if one takes a closer look at it, the result cannot be said as being very satisfying. In Flanders, the Liberals suffered a severe setback whereas the level of support for the Christian Democrats was only fractionally higher than in 1981. Between them, the two governing parties lost 6.72 % of the votes. In Brussels, the four ruling parties gained 9.89 %. This is partly due to two factors: the votes polled by Mr. Nols and, more importantly, the fact that no UDRT candidate stood in the election. It is not at all certain that a similar result would be recorded at a general election. Finally, in Wallonia, the two governing parties put up a good fight and gained 1.37 % of the votes whereas the Socialists and the Green movement made gains not because the ruling parties suffered a defeat but because of the considerable losses both by the Communist Party and by the nationalist parties. Organized only two years after the previous genera! elections, the 1987 poll, characterized by a great stability of the electorale, wilt probably have a deep political impact on the country's future.If the rate of external mobility suitably gauges the extent of the citizens' shifts in votes, the 1987 elections will have ranged among the four most stable general elections out of the twenty-two that have taken place since universal suffrage has been introduced. And yet, because of the decline of the (...) outgoing coalition, on the one hand, which is mainly due to the loss suffered by the CVP, and because of the change of majority within the Walloon Regional Council and the French-speaking Community Council, on the other, the political situation appears very different after the 13th December 1987 elections. The observer can only be struck by the asymmetrical behaviour of the voters in the northern and southern parts of the country. In Flanders, the main party is on the decline white all other parties are winning votes.However, everything seems to show that the motivation of the voters who did not vote twice for the same party in 1985 and 1987, but who, as we said, are not very numerous, was an economic and social motivationrather than a language or community-related one. The gains of Agalev, the PVV and the SP in the face of the Volksunie's status quo cannot be explained otherwise. The gains of the Vlaams Blok, notably in Antwerp, are probably due to social rather than community-linked motivations too. In the W alloon Region, on the contrary, the main party is registering an obvious gain, white the other parties are declining or stagnating. In this case, the motivations seem to be numerous : they have a social and economic background on the part of voters who trusted the main opposition party, but they are also community linked and inspired by considerations that have to do with the relationships between the Walloon and Flemish people in the Belgian State under transformation.The political prospects then appear uncertain. This is even more true that two other elections are to take place in the next eighteen months.These concern the opposite levels of the elected Assemblies: the municipal Council and the European Parliament. This book, originally published in 1876, was written in confutation of the Materialism of its time by arguments derived from Evidences of Intelligence, Design, Contrivance, and Adaptation of Means to Ends, in the Universe, and especially in Man considered in his Moral Nature, his Religious Aptitudes, and his Intellectual Powers; and in all Organic Nature. The observation also to be made and supported in the course of the book that the Will and Wisdom of the Creator may be a sufficient (...) cause for deviations from the established course of nature, and that the Free-will of man, in things within his power and influence, may be a cause of similar deviations.
